Time Limit To File An Injury Lawsuit In West Virginia And Kentucky

Each state has a time limit for filing a personal injury claim, called the “statute of limitations.” In West Virginia, you have two years from the date of the accident to file a claim in civil court. In Kentucky the statute of limitations is one year. Regardless of which state your injuries occurs it is wise to contact either a West Virginia or Kentucky personal injury attorney as soon as possible following your accident. If you fail to file your lawsuit within this time frame, the courts will likely refuse to hear your case and you will lose your right to file a claim for damages.

There are certain exceptions to the statute of limitations rules. Claims against the government require an additional procedure called a “notice of claim” before filing a traditional suit.   • DO NOT give any statements to an insurance company representative until you have consulted with an attorney.
